By accessing or using Puchify (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
You represent that you are at least the age of majority in your jurisdiction and have the authority to enter into these Terms on behalf of any entity you represent.
Puchify provides a platform for provisioning and managing cloud infrastructure resources, including servers, GPU servers, databases, Kubernetes clusters, storage, networking, domains, backups, and observability tools. The Service includes a web interface, REST API, SDKs, CLI, and Terraform provider.
Puchify does not itself provide the underlying compute, storage, or network resources. These are provisioned through third-party infrastructure providers. Puchify acts as an interface and orchestration layer.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activity that occurs under your account.
You agree to provide accurate and complete registration information and to keep it current. You may not share your account credentials or API keys with third parties except as explicitly permitted for service integrations.

We reserve the right to suspend or terminate your account for violations of these acceptable use terms, with or without notice.
You are billed for the infrastructure resources you provision through the Service. Pricing is based on resource type, plan, and duration of use. Current pricing is available on our website and in your account dashboard.
Billing is conducted through our payment processor. You are responsible for providing valid payment information and keeping it current. Late payments may result in resource suspension or account termination.
All fees are in US dollars unless otherwise specified. Prices are subject to change with 30 days' notice.
We make commercially reasonable efforts to keep the Service available and responsive. However, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted availability.
Planned maintenance will be announced in advance through our status page. Emergency maintenance may occur without advance notice.
Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data, configurations, and content you upload to or create through the Service.
You grant us a limited license to access, process, and store your data solely as necessary to provide the Service. This license terminates when your account is deleted and your data is permanently removed.
The Service, including its code, design, documentation, APIs, SDKs, CLI, and trademarks, is owned by Puchify and protected by copyright, trademark, and other intellectual property laws.
The Puchify SDKs (TypeScript, Python, Go) are open source under the MIT license. The Terraform provider is open source under the MPL 2.0 license. You may use, modify, and distribute these in accordance with their respective licenses.
You may not reproduce, reverse engineer, or create derivative works of the Service itself, except as explicitly permitted by open source licenses for SDK components.
To the maximum extent permitted by law, Puchify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of business, or service interruption.
Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
These limitations apply regardless of the theory of liability — contract, tort, strict liability, or otherwise — even if we were advised of the possibility of such damages.
You agree to indemnify and hold harmless Puchify and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party right.
You may terminate your account at any time through your account settings or by contacting us. Upon termination, you must destroy all running resources or they will be destroyed as part of the termination process.
We may terminate or suspend your account for violation of these Terms, with notice where practicable. Upon termination, your right to use the Service ceases immediately.
Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and indemnification — shall survive.
We may modify these Terms at any time. Material changes will be communicated via email or through the platform at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance of the modified Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts of Delaware.
